Welcome to Magic Erase (“Magic Erase,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Magic Erase website, applications, artificial intelligence-powered image editing tools, and related products and services (collectively, the “Services”).
By accessing or using the Services, creating an account, purchasing credits or a subscription, or uploading content for processing, you agree to these Terms. If you do not agree, do not use the Services.
1. Our Services
Magic Erase provides AI-powered and automated image editing tools that may include object removal, background removal, image enhancement, image upscaling, photo cleanup, and other image-processing features.
Features may be added, changed, limited, or discontinued as the Services evolve.
Because many features use artificial intelligence and automated processing, results are not guaranteed to be accurate, complete, error-free, or suitable for every purpose.
2. Eligibility and Accounts
You must be legally capable of entering into a binding agreement to use the Services.
Certain features may require an account. You agree to provide accurate information and are responsible for maintaining the confidentiality and security of your login credentials.
You are responsible for activity occurring through your account. Notify us promptly if you believe your account has been accessed without authorization.
3. Uploaded Content
You retain ownership of photographs, images, files, and other content you upload to Magic Erase (“User Content”).
By submitting User Content, you grant Magic Erase a limited, non-exclusive license to host, transmit, reproduce, modify, process, and otherwise use that content only as reasonably necessary to provide, secure, maintain, and improve the Services, subject to our Privacy Policy.
You represent that you own your User Content or have all rights and permissions necessary to upload and process it through the Services.
You must not upload content in violation of another person's copyright, trademark, privacy, publicity, contractual, or other legal rights.
4. AI-Generated and Edited Results
The Services may use artificial intelligence, machine learning, or other automated technologies to modify or generate images.
AI-generated or AI-edited results may contain errors, artifacts, inaccuracies, unintended modifications, or similarities to other content.
You are responsible for reviewing outputs before relying upon, publishing, distributing, selling, or otherwise using them.
Magic Erase does not guarantee that any output will be unique or that a particular output will qualify for copyright or other intellectual-property protection in any jurisdiction.
5. Credits
Some Magic Erase features require credits.
The number of credits required may vary depending on the tool, processing requirements, output quality, or other factors. Applicable credit costs should be displayed through the Services.
Credits have no cash value, cannot be exchanged for money, and generally cannot be transferred between accounts.
Unless otherwise stated at purchase, credits included with a recurring subscription may reset at the beginning of each billing cycle and unused subscription credits may not roll over.
Magic Erase may offer separately purchased credit packs under terms displayed at the time of purchase.
6. Subscriptions and Billing
Magic Erase may offer paid subscription plans billed on a recurring basis.
By purchasing a subscription, you authorize us and our payment processor to charge the applicable subscription fee and taxes using your selected payment method.
Subscriptions automatically renew at the applicable billing interval until canceled.
You may cancel your subscription through the available account or billing controls. Cancellation stops future renewals but generally does not retroactively refund charges already incurred.
Pricing, credit allowances, and plan features may change. When required, we will provide notice before a change affecting an existing recurring subscription takes effect.
7. Refunds
Except where required by law or expressly stated otherwise, payments for subscriptions, credit packages, and consumed credits are non-refundable.
If you experience a technical issue that prevents you from receiving a purchased service, contact us so we can investigate.
We may, at our discretion, restore credits or provide another appropriate remedy when processing fails because of a verified problem with our Services.
Nothing in this section limits refund or cancellation rights that cannot legally be waived.
8. Acceptable Use
You may not use Magic Erase to violate applicable law, infringe intellectual-property rights, impersonate or deceive others unlawfully, distribute malware, interfere with the Services, gain unauthorized access to systems or accounts, circumvent usage restrictions, or process content you do not have the legal right to use.
You also may not use the Services to create or distribute unlawful content or use manipulated media for fraud, harassment, exploitation, or other illegal purposes.
We may restrict or terminate access when we reasonably determine that use of the Services violates these Terms or creates security, legal, or operational risk.
9. Commercial Use
Unless a particular plan or feature states otherwise, outputs may be used for personal purposes subject to these Terms.
Where a plan expressly includes commercial use, you may use outputs generated under that plan for lawful commercial purposes, provided you have the necessary rights to the source material and your use does not violate applicable law or third-party rights.
Magic Erase does not grant you rights to trademarks, copyrighted works, likenesses, or other third-party material contained in your uploads or outputs.
10. Intellectual Property
Except for User Content, Magic Erase and its licensors retain all rights in the Services, including software, interfaces, branding, graphics, designs, trademarks, and other proprietary materials.
These Terms do not transfer ownership of the Magic Erase platform or intellectual property to you.
11. Third-Party Services
Magic Erase may rely on third-party providers for services such as AI processing, payment processing, cloud infrastructure, file storage, email delivery, authentication, and analytics.
Your use of certain functionality may therefore involve processing by third-party service providers as described in our Privacy Policy.
We are not responsible for independent third-party products or services outside our control.
12. Availability and Changes
We strive to provide reliable Services, but we do not guarantee uninterrupted or error-free availability.
Maintenance, technical failures, third-party outages, security events, or circumstances beyond our control may temporarily affect availability.
We may modify the Services as necessary to maintain, improve, secure, or develop Magic Erase.
13. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available.”
Magic Erase disclaims warranties not expressly provided in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee particular AI results, processing times, image quality, availability, or suitability for a specific purpose.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Magic Erase and its owners, affiliates, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Services.
Where permitted by law, our aggregate liability for claims relating to the Services will not exceed the amount you paid to Magic Erase during the twelve months immediately preceding the event giving rise to the claim.
Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.
15. Termination
You may stop using Magic Erase at any time.
We may suspend or terminate access to the Services when reasonably necessary because of a violation of these Terms, suspected fraud, security concerns, nonpayment, unlawful activity, or risks to Magic Erase or other users.
Provisions that by their nature should survive termination will remain effective.
16. Changes to These Terms
We may update these Terms periodically. The revised version will display an updated “Last Updated” date.
When legally required, we will provide additional notice or request consent before material changes become effective.
